The site is managed and operated by Data Media Information and Direct Marketing Ltd., company number 513387167, with its registered office at P.O. Box 959, Pardes Hanna-Karkur 3710901, ISRAEL (hereinafter referred to as “the Company” or “the Site Management”).
The following terms (“the Terms” or “Terms of Use”) define your rights and obligations regarding the use of the Site. Please read these Terms carefully, as using the Site and its content and services, including participation in the online community, constitutes your agreement to these Terms and forms a binding agreement between you and the Site Management. If you do not agree to these Terms, you are requested to refrain from using the Site.
These Terms apply to the use of the Site through any computer or other communication device (such as smartphones, etc.).
In any part of these Terms where the Site Management’s liability is detailed, it shall also refer to the liability of its employees, managers, and anyone acting on its behalf or in its name.
The Terms of Use are written in the masculine form for convenience only and refer to all genders. The term “content” or “contents” in these Terms means any textual, visual, audio content, or any combination thereof, as well as their design, processing, editing, and presentation.
About the Site
The Site includes a blog and podcast providing content and information on customer relationship management (CRM), customer experience (CX), data quality, loyalty programs, email marketing, email deliverability, and other topics. The Site also includes an online community called “Hebrew Deliverability,” where online discussions are held on core topics related to the Site.
The Site contains information and content in various fields, including professional, legal, or those requiring expertise. The information and content on the Site are intended to provide background on the Company’s services and serve as general information only. These contents do not constitute professional opinions or advice and are not a substitute for consulting, advice, professional/legal opinion, or consultation with an expert in the relevant field if needed. The use of the Site’s services and content is at your sole responsibility.
On the Site, you will also find tools for sharing and linking content from the Site through various social networks and online services provided by third parties (such as Facebook, LinkedIn, and YouTube), as well as links to the Company’s social media channels. Please note that using social networks and third-party services is done at your sole responsibility. Such sharing or use of social networks is not on behalf of the Company and will be subject to the legal documents governing the activities of these social networks and third-party services, including their terms of use and privacy policies. Using the Site
You are permitted to use the Site, its services, and content in accordance with the rules detailed below. You must not use the Site in any other way unless you have received the Company’s explicit prior written consent for such use and are subject to the terms of that consent (if given).
- You must not copy or use, or allow others to copy or use, content from the Site in any way, including on other websites, electronic publications, print publications, etc., for any purpose, whether commercial or non-commercial.

- You must not display content from the Site within a frame, visible or hidden.
- You must not display content from the Site in any way that alters their design in the Site or omits any content.
- You must not link to the Site from any site containing pornographic content, content promoting racism or discrimination, or content that is illegal or whose publication is illegal.
- You must not link to content on the Site other than the homepage (“deep linking”) and must not display or publish such content in any other way unless the deep link is to a full webpage as it appears on the Site (AS IS), allowing it to be viewed and used in exactly the same way as on the Site.
- Within this framework, it is prohibited to link directly to an image or graphic file on the Site, but only to the full page where they appear. Additionally, the exact URL of the webpage on the Site must appear in the designated place in the user interface, such as in the address bar of the user’s browser. You must not alter, distort, or hide this URL or replace it with any other URL.
The Site Management will not be liable for any damage caused by linking to content on the Site or displaying or publishing such content in any other way. You bear full and exclusive responsibility for any link, display, or publication of content made by you and undertake to indemnify the Site Management for any damage resulting from this.
Contact and Registration Forms
Using the Site does not require registration. However, certain areas and sections of the Site, such as the online community, may require registration and the provision of personal and identifying details, such as full name, phone number, active email address, and additional details as needed and depending on the circumstances.
The Site Management invites users to contact it on any matter they choose, including questions, suggestions, or complaints. For this purpose, the Site Management provides an online contact form. Additionally, the Company offers a registration form through which you can provide your contact details to receive newsletters and marketing information from the Company, including via electronic means.
When completing these forms, you will be asked to provide personal details such as first name, last name, active email address, phone number, and additional details, such as the nature of your inquiry. You must provide only accurate, complete, and correct information and, by doing so, confirm the accuracy of the details you provide. Incorrect details may prevent contact with you if needed.
Registration for the online community may be subject to prior approval by the participants and certain threshold conditions, depending on the community’s topic, nature, and the identity and character of its participants, all at the Company’s sole discretion.
The data and information you provide will be stored by the Company. You are not legally obligated to provide this information, but without it, the Site Management cannot contact you, send you information from the Company, or allow you to use services for which you register.
The Site Management will not use your details except in accordance with the Site’s privacy policy, which forms an integral part of these Terms.
By providing your details to the Company through these forms, including registration for the online community, you explicitly consent to receiving promotional materials from the Company, as defined in Section 30A of the Telecommunications (Bezeq and Broadcasting) Law, 1982 of the Israeli Law. Promotional materials will be sent to you based on the information you provide in the registration form (usually via email or text messages).
At any time, you can withdraw your consent and notify the Company of your refusal to receive promotional materials, either in general or of a specific type, by sending a notice of refusal. The method for sending a refusal notice will be detailed in the promotional materials sent to you.
When completing forms or in any other communication with the Company, you undertake to refrain from sending or providing content or information of any kind that is illegal, has a sexual nature, is harassing, insulting, hostile, harmful, threatening, coarse, racist, or contrary to law, or encourages criminal activity, or could form the basis for a lawsuit or civil liability, defames, infringes on privacy, or otherwise violates Israeli law.
The Company is entitled not to allow you to use sections of the Site that require registration or to terminate your participation in the online community at its absolute discretion. Without detracting from the above, the Company is entitled to block your access to such sections or cancel your registration to them in any of the following cases.
- If you intentionally provide incorrect details;
- If you commit an act or omission that harms or could harm the Company or any third parties, including other users, suppliers, or partners of the Company;
- If you use the Site, its services, or any of its content or communities to attempt to perform an illegal act under Israeli law or an act that appears to be illegal, or to facilitate, ease, assist, or encourage such an act;
- If you violate these Terms of Use;
- If you take any action that prevents others from registering for the Site or using it in any way.
User-Generated Content on the Site and in the Online Community
The Company may, but is not obligated to, allow you to contribute and publish information and content of your own in certain sections of the Site, such as through your activity in the online community. Such content will be published in designated areas—either on their own or alongside content from the Company. Submitting or uploading content for publication does not entitle you to demand that it be published or continue to be published.
The Company encourages freedom of expression and the conduct of a rich and fruitful discussion in the Site and its online communities, through your active participation and that of other users. However, to ensure the existence of a culturally and substantively meaningful dialogue and to prevent the misuse of the opportunities available to you to express yourself, the Company may review such content before publication, but it is not required to do so. Such reviews may be conducted on a sample basis solely to try to prevent the publication of illegal, offensive, or inappropriate content and without the need for legal discretion.
When uploading and publishing content, you bear full and exclusive responsibility for any outcome resulting from the publication. You must ensure that such content is legal. - Any content likely to deceive consumers;

- The Company is entitled to refuse to publish or immediately delete any content you submit for publication at its sole discretion, including at any time it finds that you have violated these Terms or committed an act or omission that harms or could harm the services provided on the Site, its users, the Company, or anyone acting on its behalf. In such a case, the Company may also prevent you from publishing or uploading additional content.
If the Company decides to publish or use the content you submit, it is entitled to edit such content at its discretion, including shortening it, adding suitable headings, etc. The Company is not obligated to mention your name as the source of the content you submit, but it may do so at its discretion.

However, when you submit content for publication as mentioned, you confirm that you own all rights to it and are authorized to submit it for publication. If you are not the creator or owner of the rights in the content you submit for publication, you confirm that you have the necessary legal permission from the rights owner to submit the content for publication and grant the rights of use as detailed in these Terms. The Company will not be liable for any damage resulting from the violation of rights in the content you submit for publication. You bear full and exclusive responsibility for any link, display, or publication of content made by you and undertake to indemnify the Company for any damage resulting from this.
By submitting content for publication, you grant the Company a free, worldwide, and unlimited license to copy, distribute, make available to the public, broadcast, process, edit, translate, and use the content in any other way, at its discretion, on the Site and in any derivative thereof, in any media, whether electronic or printed. This license is granted without any compensation, including acknowledgment (‘credit’), royalties, or other benefits.
The Company respects the intellectual property rights of others. If you believe that your work is being used in a way that infringes on any rights you have, please notify the Company in writing immediately. Any actions the Company may take based on information provided to it will not constitute evidence of any rights infringement.
Liability of the Site Management

The Company cannot know what responses (if any) you will receive following publication and who will respond to the content you publish. Indemnification
You undertake to indemnify the Site Management, its employees, managers, and anyone acting on its behalf for any damage, loss, loss of profit, payment, or expense (including attorney’s fees and legal expenses) that may be incurred due to your violation of these Terms of Use. Additionally, you will indemnify the Company, its employees, managers, or anyone acting on its behalf for any claim, lawsuit, or demand raised against them by any third party as a result of content you submitted for publication on the Site, or through it, or as a result of links you created, or any use you made of the Site or the online community.
Changes to the Site
The Site Management may change the structure, appearance, and design of the Site, the scope and availability of its services and content, and any other aspect related to the Site at any time without prior notice. Such changes may be made, among other reasons, due to the dynamic nature of the internet and technological changes occurring in it. By their nature, such changes may involve disruptions or cause initial inconvenience, etc. You will not have any claim, lawsuit, or demand against the Site Management regarding the implementation of such changes or disruptions that may occur during their implementation.
The Site Management is entitled to suspend the Site’s activity from time to time for maintenance, repair, upgrade, and improvement of the service. The Site Management will operate to minimize the periods during which the Site is not active.
Without detracting from the above, the Site Management is entitled to stop the Site’s activity at any time, in whole or in part. If possible, the Site Management will publish a notice on the Site about the cessation of activity a reasonable time in advance.

Governing Law and Jurisdiction

Assignment
If the Site Management transfers its rights in the Site, or any part thereof, to a third party, it may also assign its rights under these Terms of Use, all or in part, as applicable.
